Gotcha App Terms of Service

1. Overview

Welcome to the Gotcha Treasure Hunt Game (the “Game”). By participating, you (“Player” or “Participant”) agree to be bound by these Terms and Conditions, which constitute a binding legal agreement between you and Bronson Tipuna Enterprises Pty Ltd (“we,” “us,” “our”). The Game operates through our custom-designed application (“App”), where Players are required to solve trivia-based questions to locate virtual money bags. The Game times, entry fees, and conditions may change at our discretion.

 

2. Eligibility

Players must be at least 18 years of age to participate in the Game.

The Game is open to residents of Australia. Non-Australian residents may participate, but they are responsible for ensuring compliance with local laws.

Employees, contractors, or agents of Bronson Enterprises Pty Ltd, and their immediate family members, are not eligible to participate.

 

3. Entry Fee

The entry fee is $20 AUD per week, or as specified at the time of entry.

Each entry grants access to the Game for one participation period, which runs from 6:00 p.m. on Friday to 6:00 p.m. on Sunday (Queensland time), unless otherwise stated.

Payment of the entry fee is processed through the App. Once the Game has commenced, the entry fee is non-refundable (see Section 10 for details on refunds).

 

4. Game Duration and Access

The Game operates from 6:00 p.m. Friday to 6:00 p.m. Sunday (Queensland time), unless modified by us.

Upon payment of the entry fee, Players have access to the Game for the designated period. We are not responsible for personal or technical issues that may prevent participation once the Game has started.


 
5. Game Mechanics

Players are required to solve trivia questions within the App to receive clues that help them locate virtual money bags.

Upon locating and collecting a money bag, the monetary value of that money bag will be displayed, and this amount will be added to the Player’s total balance.

The total value of the collected money bags will determine the Player’s final payout, which will be issued following the Game period as described in Section 7.


  
6. Top 3 Prizes

In addition to individual payouts, the Top 3 Players who collect the most money bags by the end of the Game will receive Top 3 Prizes. These prizes may vary for each Game and will be announced before the Game begins.

In the event that two or more Players collect the same number of money bags, the prizes will be awarded as follows:

The Player who first reaches the tied number of money bags will receive the highest-ranking prize, based on our system time.

The Player who reaches the tied number second will receive the next prize, and so on.

Our decision regarding the timing and determination of winners is final, and we reserve the right to interpret the outcome in case of disputes.

If a Top 3 Prize requires physical delivery, the prize will be deemed fulfilled once we provide the Player with the tracking number and confirmation of shipment.

 

7. Payouts and Prize Distribution

Individual Payouts: Players will receive payment based on the value of the money bags they collect during the Game. Payouts will be issued to the Player’s nominated bank account within 14 business days following the Game’s conclusion.


 
Top 3 Prizes: The top 3 Players who collect the most money bags will be eligible for Top 3 Prizes, which may vary with each Game. Winners will be notified via email or through the App, with prizes distributed within 14 business days of the Game’s end.

Prize Choice: Top 3 prize winners may choose either:

To cash out the value of their collected money bags; or

To receive the designated Top 3 Prize.

Players are not permitted to select both options, and no change of mind is allowed once a choice is made. For prizes requiring shipment, the prize will be considered fulfilled upon providing tracking information to the winner.

Contact and Payment Information: Players must ensure that all contact and payment details provided are accurate. We are not liable for delays or non-delivery of payouts or prizes due to incorrect information supplied by the Player.
 


8. Fair Play and Code of Conduct

Players must participate in accordance with the rules. Any attempt to cheat, manipulate, or exploit the system (e.g., hacking or using automated tools) will result in disqualification and forfeiture of any winnings.

We reserve the right to monitor Player activity for suspicious behavior and take necessary action, including suspension or banning Players from future participation.

 

9. Technical Issues

Players are responsible for having a stable internet connection and a compatible device to access the Game.

We are not responsible for any technical issues on the Player’s side, including device malfunctions or network problems.

In the event of a system failure on our end that affects the Game’s integrity, we reserve the right to reschedule or cancel the Game. Refunds may be issued at our discretion under such circumstances.

 

10. Refunds

Refunds are available if requested before the start of the Game.

Once the Game begins, the entry fee is non-refundable.

Refunds will be processed within 14 business days of the eligible request.

 

11. Privacy Policy

We are committed to protecting your privacy. Any personal information provided will be collected, stored, and used in accordance with our Privacy Policy, which can be viewed at Privacy Policy. By participating in the Game, you consent to the use of your personal information as outlined in our Privacy Policy.

 

12. General Agreement

By participating, you agree that you have read, understood, and accepted these Terms and Conditions. This agreement supersedes all prior agreements or understandings.

You acknowledge that you are responsible for ensuring compliance with all applicable laws in your jurisdiction.

Notifications required under these Terms and Conditions may be sent via email, push notifications, or in-App notifications.

 

13. Dispute Resolution

In the event of any dispute arising from or in connection with the Game:

Initial Negotiation: The parties will use best efforts to resolve the dispute through discussions. If unresolved within 30 days of notice, mediation will follow.

Mediation: If necessary, the dispute will be submitted to mediation under the Australian Mediation Association’s rules. Costs will be shared equally.

Arbitration: If mediation fails, the dispute will be settled by binding arbitration under the Commercial Arbitration Act of Queensland, with the arbitration held in Queensland, Australia. The arbitrator’s decision will be final.

Waiver of Class Action: By participating, you agree to waive any right to a class action lawsuit or class-wide arbitration.

Governing Law: These Terms and Conditions are governed by the laws of Queensland, Australia.

 

14. Copyright and Intellectual Property

All content, design, software, and materials provided through the Game (the “Materials”) are the intellectual property of Bronson Tipuna Enterprises Pty Ltd and are protected by Australian and international copyright, trademark, and intellectual property laws.

Players may not copy, modify, distribute, or exploit any part of the Materials without our prior written consent.

Unauthorised use may result in legal action.

 

15. Deletion of Account

If a Player elects not to continue participating in the Game following the conclusion of their last Game, we reserve the right to delete the Player’s account after a period of 5 days from the conclusion of the last Game.

This deletion will encompass all personal details associated with the account, as well as any unclaimed money bags remaining in the Player’s account at the time of deletion.

Players will receive notification via email or through the App prior to the deletion of their account.

 

16. Changes to Terms and Conditions

We reserve the right to update, modify, or amend these Terms and Conditions at any time. Changes will be communicated to Players before the start of the next Game period.

 

17. Governing Law

These Terms and Conditions are governed by and will be construed in accordance with the laws of Queensland, Australia. Any disputes or claims arising in connection with the Game will be subject to the exclusive jurisdiction of Queensland courts.
